New York Bill Aims to Add Lender Requirement Prior to HECM Foreclosure

A5627/S4408 has passed the New York State Legislature. The proposed legislation would require an authorized lender that seeks to foreclose upon a reverse mortgage issued under the federal home equity conversion mortgage program to provide notice to the department of financial services and to the mortgagor.

Fannie Mae: SVC-2020-03: Servicing Guide Updates

Fannie Mae issued a release announcing updates that simplify loss draft disbursement policies while balancing risk, revise post-disaster credit reporting requirements, authorize servicers to not send a payment reminder notice to borrowers in an active forbearance plan, and encourage servicers to make borrowers aware of the Disaster Response Network.

Fannie Mae: SVC-2020-02: Servicing Guide Update

Fannie Mae issued a release announcing a number of updates relevant to servicers. Included are changes to pre-modification housing expense-to-income ratio calculation for imminent default and cash contribution, updated instructions to servicers regarding escrow shortages that are part of the full monthly contractual payment, and an update to the Mortgage Assistance Application (Form 710).

Maine Law to Allow Mortgagees to Enter Vacant Properties

Recently, LD 1963/HP 1407 (An Act to Preserve the Value of Abandoned Properties by Allowing Entry by Mortgagees) was signed by Maine Governor Janet T. Mills. Taking effect on June 15 2020,, the bill amends provisions of state law that set the process by which a plaintiff in a foreclosure action may enter property that has been abandoned by the homeowner.

Michigan Governor Approves Delinquent Property Tax Payment Law

Michigan Governor Gretchen Whitmer signed HB 5124. The bill will work to reduce the redemption amount for delinquent property taxes under certain circumstances in an effort to lower the amount of related foreclosures.

New York Foreclosure Protection Law Signed by Governor

New York Governor Andrew Cuomo signed A.5619/S.5160 (An Act to amend the real property actions and proceedings law, in relation to the failure to raise the defense of lack of standing in a mortgage foreclosure action). The legislation amends Article 13 of the Real Property Actions and Proceedings Law to protect foreclosure court defendants by allowing more leeway to raise the defense of “standing”.
