Memo 1157 - Code Enforcement

Another illustration of the importance of communication for code compliance has come to the forefront for many of our contractors. Safeguard was recently alerted that Philadelphia Code Enforcement has become aggressive in issuing violations for a variety of conditions. Some examples include cracks in the sidewalk that are 1" or greater in height, cracked or splintered porch surfaces and exterior steps that present tripping hazards or other safety concerns, and grass height that exceeds 10".

In each area of the country, the potential exists for unique situations that could trigger code violation citations and fines. Memo 1147 Code Enforcement Reporting referenced the new local regulations for the removal of trees infected with Dutch Elm Disease in Wisconsin and Minnesota. This is the type of situation that must be reported to ensure code compliance for our clients. According to Safeguard policy, our contractors must photograph and document these conditions when they are present at a property and provide bids to correct the issues.

HUD guidelines require servicers to know about and comply with all city and municipal code ordinances at all times. Servicers must take appropriate actions to prevent the issuance of code violations and preserve the condition of neighborhoods, as well as properties.

Safeguard requires our contractors to maintain current knowledge of local codes and to inform Safeguard and the client of any changes. To ensure consistent code compliance, please notify Safeguard immediately when new ordinances are implemented and enforced. Submit bids to address or cure the potential code violations along with required property preservation updates. We will continue to research local requirements and utilize the information provided by contractors to release updates to our entire contractor network and the industry.

Failure to note negative property conditions, or any possible city code violation, can result in HUD and the servicers holding Safeguard and our contractors responsible for the costs to correct the violations.
