#1004: Evictions - 9/11/02
The HUD
guidelines require our clients to obtain a pre-eviction inspection
72 hours before an eviction is scheduled to verify that the
property is still occupied before proceeding with the eviction.
If a property is found vacant on the eviction date and this
pre-eviction inspection is not documented in the file, our
clients' claims for eviction fees can be disallowed.
Therefore,
in order to keep our clients in compliance, we request these
pre-eviction inspections on every eviction order and require
our contractor to call in the eviction update on the day of
eviction. The completed written update should then be e-mailed
or updated via the web within 24 hours of the day of eviction.
Contractors should be sure to update the work completed under
the eviction work order number, not under the pre-eviction
inspection work order number.
Please
also note that you may charge the one time securing fee for
evictions only if completion of all securing work is
included for the one-time fee. Contractors should
charge fair market value for a lock change when the initial
securing fee is not applicable.
